These Terms of Use govern your access to and use of the litige.ma platform, which is dedicated to the management and resolution of real-estate and rental disputes in Morocco. This document is a reference template that should be reviewed by a qualified legal adviser before it becomes binding on users.

1. Description of the Service

litige.ma is a digital case-management platform that enables individuals and businesses to submit, organise, and track their real-estate and rental disputes. The platform provides tools for building case files, uploading supporting documents, secure communication, and, depending on the plan selected, access to legal professionals.

IMPORTANT DISCLAIMER: litige.ma is a document management and case-tracking platform. It does not constitute a law firm and does not provide legal advice, legal representation, or mediation services, except under the Lawyer plan, which explicitly involves the intervention of a bar-registered attorney. The information and tools made available on this platform do not constitute legal advice.

2. Eligibility and Access

Access to the platform is restricted to adults (individuals aged 18 or over) and duly incorporated legal entities. By creating an account, you represent that you have the legal capacity to enter into a contract and to act on your own behalf or on behalf of the entity you represent.

Use of the platform for any purpose other than those expressly intended — including fraudulent purposes, harassment, or violation of third-party rights — is strictly prohibited and may result in the immediate suspension of your account.

3. Account Creation and Security

To access the platform's features, you must create an account by providing accurate, complete and up-to-date information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

If you suspect any unauthorised use of your account, you must notify us immediately at contact@litige.ma. litige.ma shall not be liable for any damages resulting from unauthorised use of your account if you have not taken reasonable precautions to protect your credentials.

4. User Obligations and Warranties

By submitting a case on litige.ma, you represent and warrant that: (a) all information and attachments you provide are accurate, truthful, and do not infringe any third-party rights; (b) you hold all rights and permissions necessary to share the documents you upload; (c) your use of the platform complies with applicable Moroccan laws and regulations.

Providing false, misleading or fraudulent information constitutes a breach of these Terms and may result in the immediate termination of your account, as well as potential legal proceedings.

5. Plans and Billing

litige.ma offers several paid plans: (a) Standard Plan — approximately 200 MAD — covering case file creation and tracking with access to basic document tools; (b) Express Plan — approximately 1,500 MAD — providing priority case processing and enhanced support; (c) Lawyer Plan — approximately 3,500 MAD — including referral to and intervention of a bar-registered partner lawyer.

Payment is due at the time of subscribing to the selected plan. Prices are inclusive of all applicable taxes unless otherwise stated. litige.ma reserves the right to modify its pricing at any time, subject to providing users with reasonable prior notice. Price changes do not apply to cases that have already been opened and fully paid for.

6. Intellectual Property

All elements constituting the litige.ma platform — including source code, design, text, logos, icons and interfaces — are the exclusive property of the operator of litige.ma or its licensors and are protected by Moroccan and international intellectual property laws.

Users retain ownership of the documents and information they upload to the platform. By submitting such materials, users grant litige.ma a non-exclusive licence, limited to the duration of the contractual relationship, solely for the purposes of processing and archiving their case file.

7. Suspension and Termination

litige.ma reserves the right to suspend or terminate access to the platform, with or without notice, in the event of a breach of these Terms, fraudulent conduct, or any action that endangers the security of the platform or the rights of third parties.

Users may close their accounts at any time by submitting a request to contact@litige.ma. Account closure does not automatically trigger a refund; the Refund Policy provisions apply.

8. Limitation of Liability

To the extent permitted by applicable law, litige.ma shall not be liable for any indirect, incidental or consequential damages resulting from the use or inability to use the platform, including loss of data, lost profits or business harm.

The total liability of litige.ma towards a user, for any cause whatsoever, is limited to the amounts actually received for the plan subscribed by that user during the twelve (12) months preceding the event giving rise to the damage.

9. Governing Law and Dispute Resolution

These Terms are governed by Moroccan law. Any dispute relating to their interpretation or performance shall be submitted, in the absence of an amicable resolution, to the exclusive jurisdiction of the competent courts of Casablanca, Morocco.

For any questions or complaints, you may contact our team at contact@litige.ma. We will endeavour to resolve any dispute amicably as promptly as possible.
